Here are six of the most impactful modifications:
- RTDs (Ready-To-Drink Cocktails up to 12.5% ABV): Hotels, restaurants, and distributors with retail stores can now sell RTDs for off-premises consumption. To do this, they must obtain an "RTD Permit," similar to the Wine Expanded Permit (WEP). Restaurants and hotels are allowed to sell up to 192 oz. per transaction, while distributors (Ds) and importing distributors (IDs) can sell unlimited quantities.
- Direct Sales by PA Distillers: Pennsylvania distilleries, both limited and regular, that were licensed by July 1, 2024, are now permitted to sell directly to RTD permit holders. This arrangement bypasses the State Store system, enabling more streamlined distribution directly from distilleries.
- Permanent Outdoor Permits: Permits initially created during the COVID-19 pandemic for outdoor serving areas are now permanently extended. This includes spaces within 100 feet of the main building, even if they cross public thoroughfares.
- Extended Happy Hours: The allowable number of happy hours per week has been increased from 14 to 24, offering establishments greater flexibility in attracting customers.
- Happy Hour Combinations: Establishments can now offer up to two food and drink combination specials during happy hours each day, providing more options for patrons.
- Interlocking Business Work Prohibition Changes: The new regulations modify previous restrictions, allowing retail license owners to also work at manufacturing facilities, such as distilleries. Additionally, employees (excluding PLCB-approved managers) can now work across retail, distribution, and manufacturing sectors without conflict.
